Terms and Conditions of Use

Welcome to Gupy Admission!

These Terms and Conditions of Use ("Terms") apply to Client Companies as Users of the platform and services offered by GUPY TECNOLOGIA EM RECRUTAMENTO LTDA., developer and owner of Gupy Admission (hereinafter referred to as "Gupy Admission").

Overview 

These terms establish rules that must be followed when using Gupy Admission and can be consulted at any time by the Company User through Gupy Admission.

It is important for you to know that the Gupy Admission Privacy Notice is an integral part of these Terms.

The acknowledgment and acceptance of these Terms are absolutely indispensable for the use of Gupy Admission and the Services offered by Gupy. Therefore, for the correct use of Gupy Admission, you must read, ensure you have understood, and accept all the conditions established in these Terms.

Definitions

Client Company: refers to the company that contracts the services offered by Gupy, especially the services related to Gupy Admission;

Gupy: GUPY TECNOLOGIA EM RECRUTAMENTO LTDA, registered under CNPJ number 23.514.668/0001-52, headquartered at Avenida Paulista, 1079, Bela Vista, in the City of São Paulo, State of São Paulo, ZIP code 01.311-200. Manager of Gupy Admission;

Gupy Admission: Gupy's Admission Platform, which drives companies to streamline and automate the process of admitting new employees, offering solutions such as automatic document validation, electronic signature, communication with pre-employees, and customization of the hiring process;

LGPD: General Data Protection Law - Law No. 13,709, of August 14, 2018;

Artificial Intelligence: computational system capable of learning and performing tasks that normally require human intelligence;

Pre-employee: new employees in the hiring process;

Services: activities offered through Gupy Admission, upon contractual formalization;

Users: Pre-employees and Client Companies using Gupy Admission;

Company User: Collaborator of the Company using Gupy Admission for hiring processes.

Application of these Terms

These Terms will be applicable as soon as you start using Gupy Admission and will only cease to be applicable when your relationship with Gupy ends, especially in the following cases:

  • due to your detachment from the Client Company;
  • due to the termination of the contract between Gupy and the Client Company;
  • due to the application of penalties;

Services provided through Gupy Admission

Gupy offers the following Services to Client Companies through Gupy Admission:

  • receipt, rejection, and approval of the necessary documents for the admission of Pre-Employees;
  • signing of employment contracts with Pre-Employees after document approval.

Access and Usage Conditions

Registration. Your registration will be done by the administrator of Gupy Admission indicated by your company or with support from Gupy. If you wish to make any changes to your registration, access the screen of your profile or contact the administrator;

Access account. For the use of Gupy Admission, Gupy will provide you with an account, which will be accessed through email (login) and password;

Individual and non-transferable access. It is prohibited to inform these data to third parties and you will be fully responsible for their use. In case of unauthorized use of your account, you must inform us immediately, through support-company@gupy.com.br, assuming all risks arising from any unauthorized access;

Account linked to the Client Company's management platform. If your user account is linked, via single sign-on, with the Client Company's management platform (SAML), Gupy will not have access to your data nor will it be able to modify them within Gupy Admission. Any necessary changes, including password changes, must be made by contacting the administrator of Gupy Admission in the Client Company and/or the IT Department of the Client Company;

Authenticity, Updating, and Truthfulness of data. All information provided by the User to access and use the Service must be true. The User is responsible for the truthfulness, accuracy, and authenticity of the registered data, as well as for the storage, confidentiality, and proper use of login and passwords registered, releasing Gupy from any liability. It is the sole responsibility of the User to keep any information provided through Gupy Admission permanently updated to always reflect the User's real data, as applicable.

Document signing. For sending contracts for signature through Gupy Admission, Gupy partners with the company Clicksign. When registering on Gupy Admission, the Client Company will also be registered on the Clicksign platform and the Client Company will have access to and responsibility for the settings and use of its account.

General Guidelines for the Use of Gupy Admission

All information, data, texts, programs, music, sounds, photographs, graphics, videos, advertisements, messages, and other materials that may be sent, inserted, or displayed by the Client Company are the sole responsibility of the author of such content.

The Company User on behalf of the Client Company must use Gupy Admission only for lawful and authorized purposes. Gupy has the right to take measures, including the removal of job opportunities or Content, suspension or cancellation of registration, temporary or permanent, and other appropriate actions if the Company User uses Gupy Admission in violation of these Terms and in an improper manner, such as providing false information or impairing its integrity. This also applies to actions that may create liabilities for Gupy, including actions such as defaming its brand, public image, or those of its Internet providers and other suppliers.

It is prohibited for the Company User to:

  • violate/attempt to violate the security of Gupy Admission by attempting to investigate, copy, and test system vulnerabilities, network, security flaws, or authentication measures without authorization;
  • forge TCP/IP headers or any part of header information in any email or postings in newsgroups;
    aggregate, copy, or duplicate parts of Gupy Admission, including expired job opportunities;
  • adapt or provide a link to any Gupy Content or information available on the Website or the App, unless permitted by this Term;
  • post content or materials that promote or endorse false/misleading information or illegal activities, as well as information that offers instructions for illegal or prohibited activities according to this Term;
  • access third-party data, servers, or accounts that you are not authorized to access;
  • publish content containing pages with restricted access or passwords, as well as hidden pages or images;
  • attempt to interfere with services for Users, administrators, or networks, including but not limited to methods of sending viruses to the site, overload, accumulation of content-less messages, spam, "email bombs," or crashes;
  • illegally use Gupy Admission for any illegal activity, including or submitting any kind of defamatory, accusatory, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, angry, racist, discriminatory content, and content that may cause annoyance, inconvenience, humiliation, anxiety, and be considered harassment. Links to pornographic, indecent, or explicitly sexual content of any kind are also not permitted, as determined at Gupy's discretion.

Violations of system and network security may result in civil and/or criminal proceedings: Gupy will investigate occurrences that may result in violations, including but not limited to those mentioned above, and may engage and cooperate with authorities and public security agencies in punishing Users who engage in violation acts.

If falsification of identity or fraud related to the nature of the Company User's activities on Gupy Admission is identified, Gupy may, at its discretion, notify and even terminate the contract with the Company, as well as potentially constituting crimes punishable under the Penal Code.

Functionalities

  • Hiring Management

Through Gupy Admission, the Client company can use various hiring management functionalities, such as defining stages, moving Pre-Employees, consulting Pre-Employee information, downloading reports and documents, monitoring the progress of contract signing, among others.

  • Document Management and Integrations

The Client company can also use various document management and integration functionalities, such as document validation, integrations for contracts and with payroll, among others.

The Client company can manage the flow for validation of documents sent by the Pre-Employee according to the functionalities of Gupy Admission.

  • Use of Artificial Intelligence

In Gupy Admission, Artificial Intelligence is used for validation and checking of attached admission documents.

Support

The services of Gupy Admission will be available, whenever possible, 24 (twenty-four) hours a day, 7 (seven) days a week, except in cases of force majeure, third-party fault, and technical and/or operational maintenance that require temporary system shutdown or prevent access. For this reason, the User is aware that they cannot claim compensation or damages, regardless of the motivation.

Company Users can contact Gupy Support by email at support-company@gupy.com.br. Contacts will also be responded to via email, from Monday to Friday, from 9 am to 6 pm, except on holidays.

Reports

In order to provide Client Companies with information that aids in monitoring indicators, Gupy Admission allows reports to be extracted in .xlsx format regarding completed admissions, in the "Analyze Data" tab. Access to company data is controlled by permissions, and it is the total responsibility of the Client Company to responsibly use the extracted information.

Gupy's Responsability through Gupy Admission

Gupy is responsible for:

  • providing a tool for Client Companies to collect data and documents from Pre-Employees in the admission process;
  • performing the validation of Pre-Employees' documents (upon contracting);
  • storing data and documents of Pre-Employees during the contract period;

GUPY is NOT responsible for:

  • Data provided by Pre-employees

The data provided by Pre-Employees are solely their responsibility, and Gupy cannot be held responsible for errors in data entry or their accuracy.

  • Links to other sites

Gupy Admission may contain links to third-party websites, provided for your convenience and not as an endorsement by Gupy of the content on those sites. Gupy has no control over and is not responsible for the content, privacy policies, or practices of third-party websites and will not comment on the content or accuracy of third-party materials. If you access the link, the Company User assumes full responsibility.

  • Issues with the Company User's device

Issues occurring on the Company User's device such as system failures, provider issues, internet connection problems, hacking attacks, viruses, interference, piracy, or other security breaches on their device that cause harm, losses, or damages are the responsibility of the Company User to secure their information.

  • Integration with other systems

Gupy is not responsible for integrations that the Client Company performs with its systems. Gupy only provides a public API and webhooks to allow the Company to connect Gupy Admission with other systems.

Gupy is not responsible for the internal sharing of the integration token within the Client Company and any data leaks resulting from the improper use of the API by the Client Company.

Intellectual Property

The license to use Gupy Admission does not imply, in any way, the provision of the source code or internal software structure or any other technology or functionality of the platform, being the exclusive property of Gupy.

The Company User receives a limited, non-transferable, non-exclusive, royalty-free, and revocable license to download, install, run, and use Gupy Admission on their device. Selling, transferring, modifying, reverse engineering, or distributing, as well as copying texts, images, or any parts contained therein, is expressly prohibited.

The rights to all content of Gupy Admission are owned by Gupy and are protected by intellectual property rights. Users may not create derivative works, copy, sell, or distribute the content, under penalty of civil and criminal liability for infringement of intellectual property, and the use of the material must be made exclusively for private and individual use by the User. When the content is produced/provided by the Client Company, this material will be owned by the Client Company.

It is not permitted to use any of the trademarks, trade names, service marks, logos, domain names, or other intellectual property of Gupy, whether linked to Gupy Admission or not.

Privacy and Data Protection

Gupy, through Gupy Admission, is compliant and follows the guidelines established by LGPD, prioritizing user privacy, so that the personal data of Company Users collected will only be used for the specific purpose of contractual execution, in the form of service provision.

The Client Company is aware that by choosing to use Gupy Admission outside of Brazil, it may be subject to other legislations, in addition to LGPD, which may result in penalties, without Gupy having any interference.

Price

The use of Gupy Admission by Client Companies is formalized through a contract. For further information, please refer to your company's contract.

Penalties

Non-compliance with any clause of these Terms of Use may lead to the cancellation of the Company User's registration on the Platform and contractual penalties, as well as being liable for civil and criminal responsibilities.

Changes, Modifications, and Termination

Gupy reserves the right to modify these Terms at any time for legitimate reasons, and it is allowed, at any time, to modify or discontinue (temporarily or permanently) the distribution or update of Gupy Recruitment and Selection. Whenever there is a relevant change, we will make the best efforts to communicate it to you. However, we recommend that you periodically visit this page to check the latest Terms established for the use of Gupy Admission.

If any clause of these Terms becomes invalid, illegal, or unenforceable, this will not affect, in any way, the validity, legality, and enforceability of the other clauses. Gupy does not waive any of its rights by not demanding compliance with the provisions of these Terms, and may exercise them as appropriate and within legal deadlines.

This Agreement is valid indefinitely, beginning from the date of Electronic Acceptance by the Company User.

Acceptance

THESE TERMS HAVE THE NATURE OF AN ADHESION CONTRACT AND BY AGREEING TO THE PROVISIONS HEREIN AND STARTING TO USE GUPY ADMISSION, YOU EXPRESSLY, FREELY, AND INFORMEDLY AGREE TO THE TERMS AND CONDITIONS. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS DOCUMENT IN ITS ENTIRETY AND AGREE TO ITS CONDITIONS. YOU COMMIT, THEREFORE, TO IRREVOCABLY AND IRREVOCABLY RESPECT THE CONDITIONS EXPOSED HEREIN, AS WELL AS TO USE THE SERVICES OFFERED THROUGH GUPY ADMISSION BY GUPY IN A PROFITABLE AND LEGAL MANNER.

The Company User understands and acknowledges that they have legal capacity to enter into these Terms of Use and use the service.

Applicable Law and Jurisdiction

These Terms of Use are governed and interpreted according to Brazilian law, due to the services being offered in national territory, and the competent court to settle issues related to this document is the court of São Paulo-SP.
